Terms of Use
These Terms of Use (“Terms”) govern your access to and use of happyhappygolf.com and the HappyHappyGolf golf-search, planning, recommendation, and conversational features (collectively, the “Service”). By using the Service, you agree to these Terms.
1. Eligibility and acceptance
You must be legally capable of entering into these Terms. If you use the Service for an organization, you represent that you have authority to bind it. If you do not agree, do not use the Service.
2. Informational and AI-powered service
HH provides general golf information, discovery, recommendations, and planning assistance. It is not a golf-course operator, booking agent, travel agency, retailer, rules official, professional fitter, instructor, medical provider, or financial adviser. Responses may be generated with artificial intelligence and live web information and may contain errors, omissions, or outdated information.
3. Confirm important information
You are responsible for independently confirming tee-time inventory, prices, fees, cancellation terms, course access, dress codes, weather, travel requirements, schedules, broadcast availability, rules, product specifications, warranties, and other material information with the applicable official provider before acting. A link, listing, or recommendation is not a guarantee of availability, suitability, safety, or accuracy.
4. User submissions
You retain ownership of content you submit. You grant HH and its service providers a worldwide, nonexclusive, royalty-free license to host, process, reproduce, and use that content as necessary to operate, secure, and improve the Service. You represent that you have the right to submit it and that it does not violate law or another person’s rights. Do not submit confidential, highly sensitive, infringing, unlawful, or harmful material.
5. Acceptable use
You may not misuse the Service; interfere with its operation or security; probe or bypass access controls; introduce malicious code; scrape at unreasonable volume; use automated means contrary to instructions; impersonate others; submit unlawful or abusive content; violate intellectual-property, privacy, publicity, or contractual rights; or use outputs to facilitate fraud, discrimination, or harm. We may limit, suspend, or terminate access to protect the Service or others.
6. Third-party services, bookings, and media
The Service may link to or embed content from courses, tours, booking platforms, retailers, manufacturers, travel services, maps, and video platforms including YouTube. HH does not control those services and is not responsible for their availability, content, privacy practices, products, transactions, or terms. Your dealings are directly with the third party.
7. Recommendations, equipment, and safety
Equipment suggestions are general decision support, not a substitute for professional fitting or personal testing. Golf instruction is general education and may not account for physical limitations. Stop any activity that causes pain and seek an appropriate professional when needed. You assume the ordinary risks of golf, travel, and purchases.
8. Affiliate and sponsored content
HH may later receive compensation from referral links, advertising, sponsorships, or partnerships. When applicable, we will provide disclosures required by law. Compensation does not guarantee a positive recommendation, placement, availability, or result.
9. Intellectual property
The Service, HH branding, interface, original text, graphics, code, and compilation are owned by HH or its licensors and protected by applicable law. Third-party names, logos, photographs, videos, trademarks, and content remain the property of their respective owners. Except as law permits, you may not reproduce, modify, distribute, sell, or create derivative works from the Service without permission.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, CURRENT, OR UNINTERRUPTED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HH AND ITS OWNERS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON AI OUTPUT, THIRD-PARTY INFORMATION, BOOKINGS, TRAVEL, EQUIPMENT, MEDIA, OR SERVICE INTERRUPTION. WHERE LIABILITY CANNOT BE EXCLUDED, TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID HH FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HH and its owners, affiliates, licensors, and providers from claims, losses, liabilities, and expenses arising from your misuse of the Service, your submissions, your violation of these Terms, or your violation of another person’s rights.
13. Modification and termination
We may modify, suspend, or discontinue features and may update these Terms. Continued use after updated Terms become effective constitutes acceptance where permitted by law. Provisions that by their nature should survive termination will survive.
14. Governing principles and disputes
These Terms are governed by applicable law without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and attempt an informal resolution for at least 30 days, except where urgent injunctive relief is appropriate. Any mandatory consumer rights and forums available under applicable law remain unaffected.
15. General terms
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; HH may assign them in connection with its business. These Terms and the Privacy Policy form the entire agreement concerning the Service.
